Kangana-Javed defamation case: Kangana Ranaut’s petition again dismissed

A wide-ranging court has dismissed Kangana Ranaut’s plea seeking transfer of defamation suit against writer and lyricist Javed Akhtar. Kangana had alleged in her application that the magistrate hearing the case was not impartial, but the court in its order refused to accept any such irregularity on the part of the magistrate. The court said it had not found any evidence to prove that partisan action had been taken against Kangana.

According to ETimes, Javed Akhtar’s lawyer Jai Bhardwaj said ,Kangana Ranaut Has unsuccessfully challenged the procedure followed by the magistrate on 7 different occasions. Bhardwaj said Kangana had filed a revision petition before the Sessions Court, Dinoshi, challenging the summons order (passed by the 10th Metropolitan Magistrate). The entire proceedings were later challenged in the High Court on a petition seeking quashing.

Kangana’s lawyers then moved the 10th Metropolitan Magistrate seeking transfer of the case to another court and filed a transfer application before the Chief Metropolitan Magistrate (CMM) Court under Section 410 of the Criminal Procedure Code (CRPC). Done Bhardwaj said that after the rejection of transfer applications by the CMM, a revision petition was filed challenging the CMM’s orders and finally Kangana had filed a transfer application in the Dindoshi Sessions Court under Section 408 of the CRPC. .

Concerns alone cannot be considered: Court
According to ETimes, in the order shared with them, the court said that “the concern of not getting justice in the given case alone is not enough”. The court said that if it appears that there will be no impartiality and impartiality of justice before any court, the case may be transferred to another court. But such applications cannot be considered on the basis of apprehension alone. Therefore, the assurance of a fair hearing must be respected.

In fact, Javed Akhtar had lodged a complaint in November 2020, in which he claimed that Kangana Ranaut had made some objectionable statements against him in a TV interview, which had allegedly damaged his reputation. Javed’s complaint is being heard by the Andheri Metropolitan Magistrate’s Court. According to ETimes, Bhardwaj told him that the main case is now scheduled for March 22 before the 10 a.m. court.
